Terms & Conditions
Article 1 – Definitions
In these general terms and conditions, the following definitions apply:
Withdrawal period: The period during which the consumer may exercise their right of withdrawal.
Consumer: A natural person acting for purposes outside their trade, business, or profession who enters into a distance contract with the professional.
Continuous performance contract: A distance contract relating to a series of products or services where obligations are spread over time.
Right of withdrawal: The consumer’s legal right to withdraw from a distance contract within the withdrawal period.
Professional: Novina Fashion, the entity offering products remotely to consumers.
Distance contract: A contract concluded between the professional and the consumer within the framework of an organized system for distance selling.
CESOP: The Central Electronic System of Payment Information established by the European Union to monitor cross-border payments.

Article 3 – Scope of Application
These general terms and conditions apply to every offer made by Novina Fashion and to every distance contract concluded between Novina Fashion and the consumer.
Before the agreement is finalized, these terms and conditions are made available electronically or in another durable format.
Article 4 – The Offer
All offers are non-binding.
Novina Fashion reserves the right to modify or withdraw offers at any time.
The offer clearly states the total price, including any shipping costs. Where applicable, additional charges such as customs duties, VAT, import taxes, or courier handling fees are the responsibility of the customer.
Article 5 – The Contract
The contract is concluded at the moment the consumer accepts the offer and complies with the stated conditions.
Novina Fashion will confirm acceptance of the order by email without undue delay.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 14 days from the day of receipt of the product, without providing a reason.
Return shipping costs are borne by the consumer.
Article 7 – Costs in Case of Withdrawal
In the event of withdrawal, Novina Fashion will refund all payments received from the consumer within 14 days after notification of withdrawal, provided that:

The returned product has been received; and

The product is returned in its original condition and packaging.
Refunds will be issued using the original payment method.
Article 8 – Customs, Import Duties, and VAT Liability
8.1 Delivered Duty Unpaid (DDU)
All goods are shipped under the Incoterm Delivered Duty Unpaid (DDU) as defined by Incoterms 2000.
This means the customer is solely responsible for all import-related costs and obligations in the destination country.
8.2 Customer Responsibilities
These responsibilities include, but are not limited to:

Payment of import duties, VAT, GST, and any other applicable taxes

Payment of customs clearance, brokerage, inspection, or handling fees

Compliance with local import regulations, certifications, and product restrictions
8.3 Transfer of Responsibility
Legal ownership and responsibility transfer to the customer upon shipment.
Novina Fashion does not act as the importer of record and is not responsible for:

Customs delays
-
Seizures
-
Refusals
-
Fines
-
Additional charges
Failure to comply with import obligations does not entitle the customer to cancellation or refund.
8.4 Documentation
Novina Fashion provides required commercial documentation for shipping purposes. However, we do not guarantee compliance with specific technical or regulatory requirements in the destination country.
The customer is responsible for verifying import eligibility prior to placing an order.
8.5 Indemnification
The customer agrees to indemnify and hold Novina Fashion harmless from any liability, penalties, or costs arising from failure to comply with import regulations.
8.6 Recommendation
Customers are strongly advised to contact their local customs authority before placing an order to avoid unexpected charges or delays.
Article 9 – CESOP Compliance
As of 2024, payment service providers must record certain transaction data in the CESOP system in accordance with EU regulations.
Novina Fashion complies with these legal requirements.
Article 10 – Compliance and Warranty
Novina Fashion guarantees that products comply with the contract and applicable legal requirements at the time of delivery.
Any defects or non-conformities must be reported in writing within 14 days of discovery.
Products must be returned in original condition and packaging unless otherwise agreed.
Article 11 – Delivery
Orders are delivered within 30 days, unless otherwise agreed.
In the event of a delay, the consumer will be notified within 14 days of placing the order.
Products are shipped under conditions where the customer is responsible for import formalities.
Novina Fashion is not responsible for customs-related delays or clearance issues.
Failure by the customer to fulfill import obligations does not constitute grounds for cancellation or refund.
Article 12 – Complaint Resolution
Complaints must be submitted in writing within 7 days after the issue has been identified or reasonably should have been identified.
Novina Fashion will respond within 14 days of receipt.
If additional time is required, confirmation will be sent within 14 days along with an estimated response timeframe.
Article 13 – Governing Law and Disputes
These general terms and conditions are governed by Dutch law.
Disputes shall preferably be resolved amicably. If necessary, disputes will be submitted to the competent court in the Netherlands.
